Glossary of terms

2. Buyer - a natural person who is at least 18 years old, as well as a legal person and an organizational unit which is not a legal person, whose special provisions grant legal capacity, and who makes or intends to place an order or uses other services of the Online Store www.obsessionforyou .com
3. Consumer - the Buyer who is a natural person using the Online Store www.obsessionforyou.com for a purpose not related directly to his business or professional activity, who, under the rules set out herein, registers or registers in the Online Store www.obsessionforyou.com
4. Online Store obsessionforyou.com - website available at www.obsessionforyou.com, through which the Buyer can buy Products from the Seller.
5. Products - movable items presented in the Online Store www.obsessionforyou.com, which may be the subject of a sales contract.
6. Registration Form - the service is available on the website www.obsessionforyou.com, through which the Buyer, by providing his personal data, creates a user account with which he can purchase Products.
7. Order Form - a service available on the website www.obsessionforyou.com, through which a Buyer who does not have a user account can purchase Products.
8. Cart - an element of the Online Store www.obsessionforyou.com, through which the Buyer specifies the details of the order, such as: the number of products, delivery address, delivery method, payment method, etc.
9. Working days - days of the week from Monday to Friday, excluding public holidays.
10. Regulations - these Regulations of the Online Store www.obsessionforyou.com

Terms and Conditions

1. These Regulations specify the rules for concluding sales agreements between the Seller and Buyers for Products using distance communication and for Buyers to use the Online Store www.obsessionforyou.com.
2. In the scope of services provided electronically, these Regulations are the regulations referred to in art. 8 of the Act of July 18, 2002 on the provision of electronic services (Journal of Laws of 2002 No. 144, item 1204, as amended).
3. The Regulations are addressed to all Buyers in the Online Store www.obsessionforyou.com.
4. A condition of using the services of the Online Store www.obsessionforyou.com is to read these Regulations and accept them.
5. Placing an order is tantamount to agreeing to all the provisions and information contained in the Regulations.
6. The buyer is obliged to comply with all the provisions of the Regulations.
7. The sale is based on the version of the Regulations in force at the time the order was placed. The current Regulations are published on the Online Store website.
8. The Seller reserves the right to amend these Regulations at any time. Amendments to the Regulations apply from the moment they are clearly indicated and placed on the Online Store website www.obsessionforyou.com. In the case of registered Buyers, they will be bound by the provisions of the new Regulations from that moment.
9. The recognition of individual provisions of these Regulations in a manner prescribed by law as invalid or ineffective, does not affect the validity or effectiveness of the remaining provisions of the Regulations.
10. For the avoidance of doubt, it is stated that none of the provisions of these Regulations limit the rights of Buyers under their mandatory provisions of law on the territory of the Republic of Poland. In matters not covered by these Regulations, the provisions of the Act of March 2, 2000 on the protection of certain consumer rights (Journal of Laws of 2000, No. 22, item 271, as amended), the Act of July 27, 2002 shall apply. on specific conditions of consumer sales (Journal of Laws of 2002, No. 141, item 1176, as amended) and the Civil Code.
11. These Regulations shall enter into force on February 1, 2017.

II General Provisions

1. Online Store www.obsessionforyou.com sells via the Internet
2. Purchases in the Online Store www.obsessionforyou.com can only be made by adults.
3. All Products offered in the Online Store www.obsessionforyou.com.pl are new and have been introduced to the European market in accordance with applicable regulations.
4. All information contained on the Store's website regarding Products (including prices) does not constitute an offer within the meaning of art. 66 of the Civil Code but the invitation to conclude a contract specified in Article 71 of the Civil Code.
5. The Seller shall take all possible technical and organizational measures to prevent the unauthorized acquisition and modification of data provided during registration and when placing orders.
6. The buyer is obliged in particular to:
   • use the services offered by the Seller in a way that does not interfere with the functioning of the Online Store www.obsessionforyou.com., in particular through the use of specific software or devices,
   • not taking actions aimed at taking possession of classified information in the possession of the Seller
   • use the services offered by the Seller in a manner consistent with the provisions of the Regulations, as well as with the customs adopted in a given scope,
   • use the services offered by the Seller in a manner that is not burdensome for other Buyers and for the Seller, respecting their personal rights (including the right to privacy) and other rights that they have,
   • use any content posted as part of the Online Store www.obsessionforyou.com only for personal use.

III Placing orders

1. Orders are accepted via www.obsessionforyou.com.
2. Buyers have the option of buying Products via the Online Store www.obsessionforyou.com regardless of whether it is a purchase without completing the Order Form or they have registered by completing the Registration Form and creating a profile.
3. If the Buyer registers in the Online Store www.obsessionforyou.com, the order is placed by logging in to the Store's website, adding the Product to the basket and confirming the will to place the order.
4. If the Buyer fails to register, the condition for placing the order on the website www.obsessionforyou.com is to add the Product to the Basket, complete all required data in the Order Form necessary to ship the Product and take other technical actions based on the messages displayed to the Buyer or information. A condition for successful order placement is providing the Buyer with accurate address details and an indication of the telephone number or e-mail address at which the Seller will be able to contact.
5. The information provided in the Registration Form and in the Order Form should be truthful and current. In the case of providing information raising doubts as to their accuracy or timeliness, the Seller is not obliged to process the order.
6. The Seller may deprive the Buyer of the right to use the website if false or outdated data are provided in the Registration Form or the Order Form, as well as in the event of a breach of the obligations referred to in point II paragraph 7 points a-e). The buyer who has been deprived of the right to use the services of the Online Store www.obsessionforyou.com cannot re-register without the prior consent of the Seller.
7. Placing an order via the Order Form is possible around the clock, on all days of the week.
8. Sending the order by the Buyer (confirming with the Confirm order button) constitutes the Buyer's offer to the Seller regarding the conclusion of the sales contract, in accordance with the Regulations.
9. After sending the order, the Buyer receives confirmation of acceptance of his offer by e-mail (confirmation of the order being accepted), to the e-mail address provided by him. After receiving the above confirmation, the contract of sale of the Products ordered by the Buyer is concluded.
10. The buyer has the right to cancel the order before receiving confirmation from the Seller that the order will be processed. A declaration of will to resign from the order should be sent to the Seller by e-mail to the following address: bok@obsessionforyou.com
11. Successful placing an order is only possible if the Product selected by the Buyer is available in the Seller's warehouse. If it is impossible to perform the order, due to the lack of availability of the selected Product, the Seller has the right to withdraw from all or part of the contract, and the order will be canceled in whole or in part, about which the Buyer will receive information by electronic means to the e-mail address provided by him. The payment made by the Buyer for the ordered Product, which cannot be delivered, will be returned by the Seller within 7 days from the date of effective notification of the Buyer about the impossibility of completing the order.

IV. Prices. Making Payments

1. All prices of Products posted on the Online Store website www.obsessionforyou.com:
   • are given in Polish zlotys. Prices can be converted into euros.
   • are gross prices - they include VAT,
   • do not contain information about delivery costs.
   • The price given for each Product is binding from the moment the Buyer receives the confirmation of acceptance of the order for execution at the e-mail address provided by him.
   • The shipping cost of the Product is borne by the Buyer and it is added to the price for the selected Product.
   • The Seller reserves the right to change the prices of Products, carry out and cancel promotional campaigns and sales or make changes to them. The above permission does not affect the prices of Products in orders placed before the date of entry into force of the price change, terms of promotional campaigns or sales.
   • Promotions in the www.obsessionforyou.com Online Store cannot be combined, unless the regulations of the promotion provide otherwise.
   • The buyer has the right to choose the method of payment for the ordered Product:
     • electronic payment. Settlements of electronic payments and payment cards are carried out in accordance with the Customer's choice via mPAY24 website. Electronic payments and payment cards are handled by: mPAY24 GmbH Grüngasse 16 A-1050 Wien Tel. 043-1-5136633-0

   • In cases of payment by bank transfer, the shipment will be sent after payment for the order.
   • Order not paid within 3 business days of its submission will be automatically canceled.

V. Order fulfillment

1. After the Buyer receives confirmation of the order, the Seller will start the process of order fulfillment.
2. Order processing time is up to 3 business days and depends among others on:
   • the payment method chosen by the Buyer - in the case of bank transfers, the order is carried out after the payment for the Product and for delivery has been credited to the Seller's bank account,
   • Product availability.
3. The term indicated in paragraph 2 may be exceeded for reasons related to possible difficulties in the performance of the contract.
4. In the situation referred to in par. 3, the Seller shall inform the Buyer about the delay and its causes via e-mail or telephone.
5. If the order is canceled or the product is missing, the payment to the Buyer's account shall be returned within 7 business days of the event occurrence.
6. The completion of the order is understood as the delivery of the parcel by the Online Store www.obsessionforyou.com to the courier's representative.
7. Products are delivered to the indicated address in the European Union via courier. The estimated delivery time of the Product by courier depends on the location to which the package is to be delivered. This time limit may change due to circumstances attributable to the courier company, on which the Seller has no influence.
8. Courier is not obliged to contact the Buyer by phone (recipient of the package) before delivery.
9. Buyer, when picking up the parcel with the order, should check the status of the parcel in the presence of the courier. In the event of damage to or damage to the packaging, a damage report should be made in the presence of the courier, which should be immediately sent to the Seller together with any complaint.
10. If the delivered parcel is affected by traces of external damage, it should be refused and the Online Store www.obsessionforyou.com will explain the situation with the courier without delay and will resend the ordered parcel without additional charges.
11. Orders are processed in the order they are received, while supplies last.
12. Proof of purchase is attached to each shipment.

VI. The right to withdraw from the contract

1. The buyer who is a consumer, in accordance with the provisions of the Act of 30 May 2014 on consumer rights (Journal of Laws of 2017, item 683, as amended) is entitled to withdraw from a distance contract without giving a reason by sending an appropriate written statement to the Seller's address within 14 days from the date of delivery of the goods. To meet the deadline, it is enough to send a statement before its expiry. The statement should be sent by post to the address of the Seller's registered office: Obsession For You Sebastianplatz 5 A-1030 Wien, Austria or ul. gen. Henryka Dąbrowskiego 10 place 3, 41-500 Chorzów, Poland.
2. If you exercise your right of withdrawal, a distance contract is considered void. What the parties have rendered is returned unchanged. The consumer should immediately return the purchased goods, no later than within 14 days.
3. A model statement of withdrawal from the contract without giving a reason is attached as Annex A. This model is an example and is only intended to help the Buyer exercise the right of withdrawal.
4. The buyer should properly secure (pack) the returned goods in a way that prevents their destruction or damage in transit. The returned goods must be accompanied by the proof of sale received along with the goods.
5. In the event of successful withdrawal from the contract, the refund of the amount paid by the Consumer will take place without undue delay, no later than within 7 days of receipt of the return shipment by the Seller. The consumer should inform the Seller about the way he wants to receive a refund of the amount paid (bank transfer or remittance to the address provided).
6. The cost of packaging and returning the Product shall be borne by the Buyer. The store does not accept parcels sent COD

VII. Non-compliance of goods with the contract

Claims

1. In the event of non-compliance of the product with the order, the Online Store www.obsessionforyou.com is liable to the Buyer who is a consumer in accordance with the provisions of the Act of 27 July 2002 on special conditions of consumer sales (Journal of Laws of 2002, No. 141, item 1176, as amended). The buyer loses the rights set out in the aforementioned Act if he does not notify the Store of this fact before the lapse of 2 (two) months from finding the product does not comply with the order.
2. In the event of non-compliance of the product with the order, the complained product in the unaltered state (without signs of use and damage), together with the proof of purchase and a letter stating the type of non-compliance and expectations regarding how to resolve the problem, should be sent to the Seller's address: Obsession For You Sebastianplatz 5 A -1030 Wien, Austria or ul. gen. Henryka Dąbrowskiego 10 place 3, 41-500 Chorzów, Poland.
3. The cost of delivery of the complained Product to the Seller is covered by the Buyer. The store does not accept any packages sent on delivery.
4. Specifying the method of solving the problem, the Buyer has the right to request the Seller to bring the order into conformity with the order through a free replacement, unless the exchange is impossible for reasons beyond the control of the Store. If the Seller is unable to comply with certain requests, the Buyer has the right to demand a price reduction or may cancel the order (withdrawal from the contract).
5. Online Store www.obsessionforyou.com reserves the right to a 14-day complaint consideration period from the date of notification of non-compliance of the Product with the order. The day of submitting a complaint is the day of delivery of the complained Product to the Seller's address: Obsession For You Sebastianplatz 5 A-1030 Wien, Austria or ul. gen. Henryka Dąbrowskiego 10 place 3, 41-500 Chorzów, Poland.
6. If a complaint is considered in favor of the Buyer, it is possible to exchange the complained Product for another one or refund to the bank account indicated by the Buyer. The return will be processed within 14 days from the date of consideration of the complaint.
7. When the fulfillment of Buyer's requests involves the delivery of a new Product, the costs of its delivery shall be borne by the Seller.
8. The right to withdraw from the order does not apply if the Seller finds that the returned product has traces of use or is affected by mechanical damage of external origin.
9. In the case of sales not constituting consumer sales, the provisions contained in articles 556-576 of the Civil Code shall be excluded.

VIII. Personal data protection

1. Personal data provided by the Buyers of the Online Store www.obsessionforyou.com are processed by Obsession For You Sebastianplatz 5 A-1030 Wien, Austria
2. During registration or placing an order in the Online Store www.obsessionforyou.com, the Buyer agrees to the processing of personal data related to the implementation of orders made in the Online Store www.obsessionforyou.com.
3. Entrusted personal data is used only for:
   • performance of the contract,
   • if the Buyer agrees, in order to inform about new Products, services and promotions offered by Obsession For You Sebastianplatz 5 A-1030 Wien, Austria.
   • Personal data is not shared with other entities for marketing purposes.
   • The buyer has the right to access their data and correct them - at www.obsessionforyou.com in the My data tab, the Buyer after registering has access to his data and can change it. Entrusted personal data are stored and secured in accordance with the principles set out in applicable law.

IX. Final provisions

1. The Seller is not responsible for the administrators of mail servers sending messages to the e-mail address provided by the Buyer and for the removal and blocking of e-mail messages by software installed on the computer used by the Buyer.
2. The Seller shall not be liable for transactions made by unauthorized third parties who have gained access to the Buyer's account as a result of the Buyer's failure to comply with prudential rules when using the account login and password.
3. Any disputes not resolved by mutual agreement of the parties in the event of disputes involving consumers shall be settled by the appropriate common courts, and in the case of other Buyers the courts competent for the seat of the Seller.
